LAVENDER, Justice:

The City of Tulsa, Oklahoma (Tulsa or appellee) is a home rule municipality. Under its charter provisions and through city ordinance adopted February 13, 1970, a street improvement district was created to improve by widening from two to four lanes Memorial Avenue between East 11th Street and East 41st Street in Tulsa. April 28, 1971, prior to completion of the project on May 12, 1971, 11 O.S.1971, §§ 85 and 85.1 1 became effective.
