Kane, J.
During the course of an argument with his girlfriend (hereinafter the victim), defendant kicked her in the head with his steel-toed boot. He was arrested and later charged by indictment with assault in the second degree and criminal possession of a weapon in the third degree. At arraignment, Queensbury Town Court issued an order of protection in the victim’s favor.
