Statement of the Case
Respondent General Insurance Company of America brought this action to recover money alleged to be due and owing from appellants upon a written contract for the construction of a hotel building and related facilities and for extra work performed beyond that called for in the contract.
Respondent was the surety on the performance bond of Centron Construction Company, the original contractor. During the course of construction Centron defaulted and appellants demanded that respondent perform in conformity with the terms of its bond. Accordingly, respondent…
