Appellant and cross-respondent Tolmie (hereinafter referred to as appellant), and respondent and cross-appellant San Diego Fruit & Produce Company (hereinafter referred to as respondent), in 1925 entered into and thereafter for approximately nine years engaged in a joint venture of dealing in, growing and marketing potatoes and peas in the states of Idaho and Washington. By the terms of their agreement appellant received a salary of $100 a month, later increased to $150 a month, to be paid as a part of the cost of the business of the joint venture, and the net profits were to be divided in…
