This case was transferred to the district court of appeal of the third district and after the decision by that court, both sides applied for a transfer to this court. In the main we approve of the opinion written by Mr. Justice Hart in that court and we adopt the statement of facts prepared by him and the legal conclusions reached by him in that portion of the opinion so prepared hereinafter quoted, as follows:
