delivered the opinion of the court.

Appellant’s attorneys insist that the judgment in this case must be set aside upon the ground that under the evidence appellee’s injuries were not caused by any negligence on the part of appellant. This is without doubt the controlling question.

The negligence charged in the declaration is that appellant failed and neglected to take precautions to protect or guard the third or “live” rail used for transmitting electric power to propel its trains, or to give any notice or warning by signs or otherwise of the presence or location of…
