delivered the opinion of the court.

This is an appeal by defendant from a judgment in the sum of $5,000 entered upon the verdict of a jury in an action on the case for personal injuries, motions for a new trial and in arrest having been overruled.

Defendant operates an amusement park, and one of the amusement devices operated in connection therewith is usually described as a “merry-go-round.” In a general way it consists of a circular revolving platform on which are installed in rows chariots and what are described a.s stationary and plunging horses.
