DARDEN, Judge:

Arraigned and tried by general court-martial at Chu Lai, Republic of Vietnam, accused was found guilty of *135premeditated murder and sentenced to dishonorable discharge, total forfeitures, confinement at hard labor for life, and reduction to the pay grade of E-l. Intermediate appellate authorities affirmed the findings and sentence, but reduced the period of confinement to twenty-five years. This Court granted the accused’s petition for review on two issues. For the reasons stated below, we affirm the decision of the board of review.
