OPINION AND ORDER

HODGES, Judge.

Plaintiff Bell BCI filed a bid protest challenging a contract award by the Architect of the Capitol. Defendant filed a motion to dismiss for lack of jurisdiction pursuant to Rule 12(b)(1). The Government contends that this court cannot review procurement decisions by the Architect of the Capitol because that office is not a Federal agency, and that the Architect is a part of the Legislative Branch. Defendant has not established that the Architect is not a Federal agency for jurisdictional purposes, or that this court’s Tucker Act jurisdiction would be foreclosed…
