Claudette Dyback, the plaintiff, filed suit in the circuit court of Lake County against Arthur J. Weber and Francis E. Weber, d/b/a Weber Construction Company, following a fire that damaged her home. She alleged that the fire was caused by the negligence of the defendants in leaving a fuel-oil heater on the premises where they were making repairs and, alternatively, in a second count that the defendants were liable under the doctrine of res ipsa loquitur.
