EVERETT, Chief Judge:

Appellant was tried at Mainz-Gonsenheim, Germany, by a general court-martial composed of officers. Charge I alleged that he conspired with Private First Class Kasimer W. Rutherford and Bettina Grupe to wrongfully use heroin, in violation of Article 81 of the Uniform Code of Military Justice, 10 U.S.C. § 881. According to Charge II, appellant, in conjunction with Rutherford and Grupe, violated a general regulation by wrongfully possessing a hypodermic syringe needle, contrary to Article 92 of the Code, 10 U.S.C. § 892.
