WALTERS, Judge.

Danny Gleason appeals from the district court’s memorandum opinion and order affirming his judgment of conviction entered in the magistrate division after a jury found him guilty of driving under the influence, I.C. § 18-8004. On appeal, Gleason asserts that the jury was improperly instructed, that his Miranda rights were violated and that the magistrate improperly assisted the prosecution.
