THOMAS, Justice.

The appellee in this case filed a petition for a declaratory judgment against the City of Birmingham, et al., appellants, to secure a declaration as to his rights with respect to the policemen’s pension fund. Appellee alleged that he became employed as a policeman by and for said city on May 12, 1926, and continued in such employment until Jan. 28, 1936, when he was retired on a pension of $85 per month on account of permanent ánd total disability suffered in line of duty as a member of such police department.
