We are asked to review the intermediate -order striking out the stipulation entered into between appellant’s counsel and the city attorney and determining that respondent was entitled to an attorney of its own choosing. 'The effect of the stipulation, if carried out, would have been to submit the question of appellant’s right to a pension to the decision of the court on the facts stated in the petition. The city attorney subsequently filed a demurrer which raised thé same question. The motion of the attornéy employed by respondent to quash the writ raised a like question. The decision of such…
