In this action for injunction and damages filed on December 23, 1958, plaintiffs, owners of certain described parcels of undeveloped land within the city limits of Palm Springs, sought to permanently enjoin defendant and appellant KPAL Broadcasting Corporation (hereinafter referred to as KPAL) from constructing or proceeding with construction of a radio transmitting tower on adjoining land in said city limits owned by certain Indians and leased by them for radio purposes to defendant KPAL for a term of five years.
