The petition was filed by defendant Greenfield and it alleges that he has perfected an appeal from a preliminary injunction granted by the court below; it further alleges that the perfecting of the appeal has stayed the operation of said *175injunction because of the fact that it is mandatory in character. The answer filed to the petition denies certain allegations in the petition, and particularly the one alleging the injunction to be mandatory.
