Martin, J.:
The Casualty Company of America was a New York corporation authorized to underwrite the kinds of insurance permitted by subdivisions 2, 3, 4, 5, 6, 7, 8 and 9 of section 70 of the Insurance Law of New York. In 1914 the company, as a condition prerequisite to acquiring permission to do business in the State of Texas, deposited with the Treasurer of that State securities of the value of $50,000.
