MEMORANDUM OPINION

JOHN D. BATES, District Judge.

Plaintiff Michael Marsoun alleges that the Internal Revenue Service (“IRS”) has acted in disregard of federal tax law and regulations in connection with the collection of taxes for tax years 1990 through 2003. He seeks damages against defendant United States pursuant to 26 U.S.C. § 7433 and the U.S. Constitution. Presently pending before the Court is defendant’s motion to dismiss the amended complaint for lack of subject matter jurisdiction or, in the alternative, for failure to state a claim upon which relief can be granted.
