The plaintiff, Benjamen A. Miller, filed this action against Mayor Vincent C. Gray, in his official capacity, alleging that he was denied teaching positions with the District of Columbia Public Schools (“DCPS”) for three consecutive years from 2009 to 2011, in violation of the Age Discrimination in Employment Act (“ADEA”) and District of Columbia Human Rights Act (“DCHRA”), and in retaliation for the exercise of his rights under these statutes.
