On the 23rd day of February, 1937, while employed as helper upon a truck plaintiff had taken, some furniture off of a freight elevator. Upon returning to the elevator he found its entrance gate open and walked through the opening thinking that the elevator was in the place where he had left it. In the meantime, however, some one had caused the elevator to move to another floor, and for some reason, which is not shown, the gate did not come down and close the entry on the floor where plaintiff was working, although, in the normal use of the elevator, the entry gates are automatically closed…
