The plaintiff and appellant is the widow of James Lee Vale, deceased, who died of pneumonia on January 15, 1937,. at Portland, Oregon. Claiming that his death was the result of a personal injury sustained by accident arising out of and in the course of his employment while the deceased was subject to the Workmen’s Compensation Law, the plaintiff applied to the State Industrial Accident Commission for benefits as provided in the law.
