A rehearing was granted in this case and arguments both written and oral have been presented by counsel for the respective parties and by amici curiae, to which we have given careful consideration. As a result we find ourselves confirmed in the belief that our views expressed in the first decision were and are correct and not in conflict with any previous decisions of our state appellate courts, excepting that in Estate of Clark, 117 Cal.
