Elmer Franklin O’Dell, hereinafter referred to as the defendant, was arrested by a police officer of the City of Knoxville, hereinafter referred to as the City. Pursuant to the arrest a warrant was issued on June 24, 1963, charging defendant with “operating an automobile upon the public streets of the City of Knox ville while under the influence of an intoxicant,” which quoted words were stamped in the face of the warrant in red ink by means of a rubber' stamp. The warrant was issued over the facsimile signature of the City Judge of Knoxville, which was stamped in red ink by means of a rubber…
