MEMORANDUM OPINION

RICHARD LEON, District Judge.

Plaintiff, Brian Hunter (“Hunter”) filed a complaint on July 23, 2007, seeking a declaratory judgment regarding the Federal Energy Regulatory Commission’s (“FERC”) assertion of jurisdiction over him and a temporary restraining order and a preliminary injunction to enjoin FERC from proceeding with its enforcement action. On December 10, 2007, the Court denied Hunter’s request for a preliminary injunction. 1 See Hunter v. FERC, 527 F.Supp.2d 9 (D.D.C.2007).
