GARDNER, Circuit Judge.

This is an appeal from a judgment for the recovery by appellee against the appellant of the sum of $10,780, as damages and costs on account of certain bonds issued by appellant for local improvements. For convenience, the parties will be referred to as they were designated in the lower court.

In 1921 the city of McLaughlin, in South Dakota, created a sewer district, which included only a part of the city, for the purpose of constructing certain service sewers within the district. Proper plans and specifications were made and adopted, and special assessments were…
