KENNEDY, District Judge.
This is a suit to recover the sum of $4,963.97, with interest, on account of the alleged reduction by the defendant in assessments upon property holders in a local Improvement District to be collected for the purpose of paying the bonds issued by the municipality, of some of which the plaintiff is the owner and'holder. In addition to the defense of general denial, the defendant asserts that the plaintiff, having had notice, is barred by the statute of limitations.
