This action was originally brought by O. K. Cochran against Winterine Manufacturing Company, a corporation, to recover damages for breach of warranty. In an amended complaint H. D. McDonald, doing business as McDonald & Company, was joined as a defendant. The plaintiff was unable to secure legal service of process upon Winterine Manufacturing Company, and the case proceeded to trial against McDonald & Company as the sole defendant.
