This suit is on a policy of life insurance and was tried without the aid of a jury. The court- filed findings of facts and declarations of law and rendered judgment for plaintiffs in the sum of $4,496.10. After the overruling of the motions for a new trial and in arrest of judgment defendant made formal application for an appeal to the Supreme Court but was allowed an appeal to this court.
