Presently before the Court is Defendant’s Motion for Summary Judgment (Document #26). For the reasons stated herein, the motion is granted and plaintiffs complaint is dismissed.
I. FACTS
On September 30, 1988 the Arkansas De-' partment of Pollution Control & Ecology (ADPC & E) issued Federal National Pollutant Discharge Elimination System (NPDES) Permit No. AR0042901 to defendant, ICI Americas, Inc.
