MEMORANDUM OPINION
JUSTICE, District Judge.
I. Background
Plaintiffs, Phyllis Glazer and Mothers Organized to Stop Environmental Sins (“M.O.S.E.S.”), filed an original complaint against defendant Gibraltar Chemical Resources, Inc. 1 (“Gibraltar”) seeking civil penalties, as well as declaratory and injunctive relief for alleged violations of the Clean Air Act (“CAA”), 42 U.S.C. § 7401 et seq., and the Resource Conservation and Recovery Act (“RCRA”), 42 U.S.C. § 6901 et seq.
