SPATT, District Judge.

In this action to recover under the terms of a commercial insurance policy, the defendant moves to dismiss those portions of the plaintiffs Amended Complaint brought pursuant to New York General Business Law § 349 as well as those seeking punitive damages.

I. FACTUAL BACKGROUND
