The Parties will be referred to herein as they appear in the trial court, Paschal Investment Company, assignee of Peoples Bank Trust Company, as plaintiff, and Brodie T. Atwater, as defendant.

This is an appeal from an order of the district court of Okmulgee county confirming sheriff's sale of minerals levied upon and sold under a general execution.
