Plaintiff lived on the north side of a highway, 20 to 25 rods east of the defendant’s railroad, 3 miles north of the village of Kalkaska, in Kalkaska county. The railroad, which there runs north and south, crosses the highway at right angles. This action is for damages for the alleged negligent killing of plaintiff’s 18 months old daughter at the crossing August 13, 1910.
