This is an appeal by claimant-appellant, Larry Elsass (“appellant”), from an amended judgment of the Union County Common Pleas Court, entered April 16, 1991, overruling appellant’s motion for summary judgment and sustaining the motion for summary judgment of employer-appellee, Commercial Carriers, Inc. (“appellee”).

The case originated as an appeal, to the court of common pleas, from a decision of the Industrial Commission, granting appellant’s workers’ compensation claim for injuries allegedly sustained in the course of and arising out of his employment as a truck driver.
