BUDGE, J. —
This action was brought by respondent to recover damages for alienation of the affections of his wife by appellant. 'The cause was tried by the court and a jury, resulting in a verdict in favor of respondent and assessing his damage in the sum of one dollar, upon which verdict judgment was entered. Respondent thereafter made a motion for new trial, which was granted. From the order granting a new trial this appeal is taken.
Appellant assigns as error the action of the trial court in granting a new trial and in setting aside the verdict and the judgment based thereon.
