—This appeal is taken from an order granting plaintiff.a new trial. The case has once been before the court. (Hearne v. De Young, 119 Cal. 670.) It is an action for damages, based upon an alleged libelous publication in defendant De Young’s newspaper. Upon the return of the case to the lower court for a second trial, the complaint was amended, thereby counting alone upon that portion of the published article relating to the murder of one Dr. Stillwell at Hannibal, Missouri.
