For a statement of the facts and of the law applicable to this case reference is made to the opinion of this court tiled therein heretofore. 42 U. S. App. 21, 20 C. C. A. 503, and 74 Fed. 444. The judgment rendered in favor of the plaintiff below was reversed when this case was first before this court, and the court below was directed to grant a new trial, and to proceed in the man*904ner indicated by the opinion then filed.
