This is a writ of error from a judgment for the amount of a policy of insurance .upon the life of Jackson Riddle, issued on the twentieth day of September, 1871, by the Phoenix Mutual Life Insurance Company of Hartford, Connecticut.
The policy purports to have been issued in consideration as well of the representations made in the application for insurance, as of the payment by the wife and children of- the insured (the payees named in the policy) of the sum of $215, and the annual payment of a like amount on or before the' twentieth day of September in every year during its continuance.
