OPINION AND ORDER
SMITH, Senior Judge:
This case arises out of an alleged violation of the Equal Pay Act, 29 U.S.C. § 209(d) (“EPA”), in which the Plaintiff, Mr. Branch, claims that he is receiving disparate pay on the basis of gender. While the evidence clearly shows that Mr. Branch was a very good and highly motivated employee, Ms. Navarro’s disparate pay grade was not the result of sex discrimination. While the agency engaged in a bit of bureaucratic disingen-uousness, aimed at giving Ms. Navarro tasks that would rationally justify her higher grade, they did not violate any statutes or…
