Appeal from judgment on the judgment-roll.
In August, 1901, plaintiff and defendant entered into a written contract, by the terms of which defendant was to construct a dwelling-house for plaintiff upon a lot described in the contract for the sum of one thousand and sixty dollars, payable in installments as provided therein.
