KASOLD, Judge:
Pending before the Court is veteran Randolph S. Gurley’s October 28, 2005, application for attorney fees and expenses pursuant to the Equal Access to Justice Act (EAJA), 28 U.S.C. § 2412(d), in the amount of $6,429.72. The Secretary filed a response in which he argues that the EAJA application should be denied because the appellant is not a “prevailing party” within the meaning of the statute.
