This is an appeal by the plaintiffs from an order of the district court of the county of Pine denying their motion for a new trial in an action by them to enforce specific performance of an alleged executory contract to convey land.
The trial court found that on February 16, 1901, the defendants Wallace C. Nickerson and Ernest A. Nickerson were owners as tenants in common of the land here in controversy — some eighty-five hundred acres — and particularly described in the complaint. On that day Wallace C.
