This is an action to enforce specific performance of a contract to convey real estate.
The trial court found, with others not here material, substantially these facts: On February 2, 1887, the defendant railway company agreed to sell to the plaintiff one hundred thousand acres of land situate in different counties in Minnesota, and a separate written contract for the sale of the lands in each township was made, and delivered to the plaintiff by the defendant railway company and the defendant trust company; the latter having a mortgage on the lands.
