Plaintiffs-appellants, Phoenix Concrete, Inc. (“plaintiff’ or “Phoenix Concrete”), and Creekway Development Company (“plaintiff’ or “Creekway Development”), appeal from a judgment of the Franklin County Court of Common Pleas and raise the following two assignments of error:
