The above entitled cause has been before this court on a former appeal, and the opinion of the court is reported in 29 Okla. 351, 116 Pac. 908, where a full statement of the facts and the nature of the case may be found. As the opinion then rendered contains the law of the case upon the retrial ordered, there will be no restatement of the facts or re-examination of the points of law formerly decided, except such as may be necessary to an understanding of the new questions which arose on the retrial of the cause after it had been reversed and remanded for a new trial.
