OPINION

BRUGGINK, Judge.

This action was brought pursuant to the Contract Disputes Act. 41 U.S.C. §§ 601-613 (1988). Pending is defendant’s motion for summary judgment. For the reasons that follow, the court concludes that defen*819dant has not demonstrated an entitlement to entry of judgment in its favor.

FACTUAL BACKGROUND
