Nathan v. St. Paul Mutual Insurance
Supreme Court of Minnesota
1Opinion of the Court
Knutson, Justice.
This is an appeal from an order denying plaintiff’s motion for judgment notwithstanding the verdict or for a new trial.
The case arises out of the destruction by fire of a multiple-unit dwelling house located in the village of Fosston, in this state, on January 27, 1952. This is the second appearance of the case before us. In the first appeal, we granted a new trial because of errors in admitting evidence of the value of the insured property at or prior to the time of the issuance of a “valued policy” under our statute.
