OPINION

REILLY, Judge.

Relator-landowner Jeffery August challenges respondent Chisago County Board of Commissioners’ (county board) denial of his conditional-use permit (CUP) application. August argues that (1) the county board’s denial was arbitrary and capricious and (2) the county board erred when it failed to consider certain Minnesota Pollu tion Control Agency (MPCA) rules. Additionally, August seeks sanctions and attorney fees under Minn.Stat. § 549.211 (2014). We affirm.
