Alleging that he was struck by a taxicab owned by the Red Top Cab Company and the Consolidated Cab Company, thereby sustaining personal injuries, the plaintiff instituted this action against the driver of the taxicab and against the receiver for the taxicab companies to recover for the injuries suffered. Defendants’ motions (made at the close of plaintiff’s case and at the conclusion of the taking of the evidence) for judgment, upon the ground that plaintiff’s contributory negligence barred recovery, were denied.
