delivered the opinion of the court.

This is an action brought against the City of Chicago by plaintiff, Theresa Prill, as executrix of the estate of August Prill, deceased, for damages for his death which it is alleged resulted from injuries sustained when he fell into an excavation in Clybourn avenue near Southport avenue. The case was tried before the court and a jury. A verdict was returned by the jury in favor of plaintiff and against the defendant for $1,500 damages.
